Language of instruction: The course will be given in English on demand
Aim
The objective of the course is to provide an understanding of
the legal and societal cultures concerning real estate in other
countries as well as give a comparative perspective as to the
Swedish real estate system. The course also provides an
understanding of the importance of such systems, and an in depth
understanding of the development and design of the Swedish
system.
Learning outcomes
Knowledge and understanding
For a passing grade the student must
- have mastered the basic English terminology in the area of real
estate law and planning
- be familiar with some international legal systems concerning
real estate and hos the real estate planning system function in
some other countries and be able to describe how they differ
- be able to show that which Swedish real estate law and real
estate planning has in common and how it differs from some other
systems
- be able to explain some theoretical perspectives on joint
management of land - commons.
- be abloe to analyze different models of joint management of
land in other countries
Competences and skills
For a passing grade the student must
- based on English legal sources, be able to describe in Swedish
the content of the regulations found in real estate law and real
estate planning and their background
- be able to describe the Swedish system of land tenure and land
management in English
- understand, analyze and solve issues in real estate planning
that might occur in development projects in the real estate
area
- be able to apply the Swedish perspectives on joint properties
and joint facilities in an international context.
Judgement and approach
For a passing grade the student must
- Be able to apply legal regulations existing within different
systems as to fundamental real estate law and real estate planning
problems.
- be able to understand and evaluate land tenure systems in other
countries, based on their perspectives, costumary systems and other
traditions.
Contents
The course is presented as a series of lectures and seminars
with the individual student contributing with independent
investigative work.
The following issues are focussed:
- title and deed registration, and land registration
- customary rights, commons and development of real estate
systems
- the role of physical planning and at permits (building permit
and development drafts) for the land tenure systems
- eminent domain, compulsory purchase and other methods for
takings of land
- solutions for management of land based on market economy
solutions
Real estate law in developing and transitional countries that
previously have had a socialistic system ar also addressed.
Examination details
Grading scale: TH - (U,3,4,5) - (Fail, Three, Four, Five)
Assessment: Compulsory participation in seminars and exercise classes, including notes/reports. Final individual written report.
The examiner, in consultation with Disability Support Services, may deviate from the regular form of examination in order to provide a permanently disabled student with a form of examination equivalent to that of a student without a disability.
