INTERNATIONAL REAL ESTATE LAW

VFR071

Credits: 7,5. Grading scale: TH. Cycle: A (Second Cycle). Main field: Technology. Language of instruction: The course will be given in Swedish. Optional for: L4fr. Aim
The objective of the course is to provide an understanding of the legal and societal cultures concerning real estate in other countries as well as give a comparative perspective as to the Swedish real estate system. The course also provides an important basis of knowledge for those persons who will be working internationally with real estate issues.

Knowledge and understanding
For a passing grade the student must

Be familiar with the dominant legal systems concerning real estate existing in the world and be able to describe how they differ;
Be able to show that which Swedish real estate law has in common and how it differs from the Anglo-Saxon and continental European systems; and
Have mastered the basic English terminology in the area of real estate law.

Skills and abilities
For a passing grade the student must

Based on English legal sources, be able to describe in Swedish the content of the regulations found in real estate law and their background; and
Be able to find and interpret legal sources - legislation, cases, legislative preparatory works and scholarly writings - from other countries.

Judgement and approach
For a passing grade the student must

Be able to apply legal regulations existing within different systems as to fundamental real estate law problems, such a mortgaging deeds or the conveyance of ownership. Those students who have completed the course should be able to compare and evaluate different solutions available when forming a new system in developing and transitional countries.

Contents
The course is presented as a series of lectures and seminars with the individual student contributing with independent investigative work. The course primarily focuses on pure private law moments of real estate law, such as:

Forms of conveyances;
Mortgaging;
Rights of use and easements;
Adverse possession; and
The registration of interests in property.

The Anglo-Saxon legal system will be treated more in depth, however, continental law will also be examined. Real estate law in developing and transitional countries that previously have had a socialistic system will also be addressed.
